Terms of Service

These Terms of Service ("Terms") govern your use of the Popup Chrome extension and its associated website and account services (collectively, the "Service"), operated by the Popup developer ("we," "us," or "our"). By creating an account or installing the extension, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

Popup is a Chrome browser extension that assists Depop sellers in relisting their own Depop listings in bulk, generating AI-optimized listing descriptions, and automating relist scheduling. The Service operates by reading your authenticated Depop session and making API requests to Depop on your behalf.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you must have a parent or guardian's consent.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

Provide accurate and current information when creating your account.
Notify us immediately at support@popupbot.net if you suspect unauthorized use of your account.
Not share your account credentials with any other person.

We reserve the right to suspend or terminate accounts that we believe have been compromised or are being used in violation of these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and only on your own Depop account. You may not:

Use the Service on a Depop account that you do not own or have explicit authorization to manage.
Use the Service in any way that violates Depop's Terms of Service.
Use the Service to relist items you do not own or are not legally permitted to sell.
Use the Service to post spam, misleading, or fraudulent listings.
Attempt to reverse-engineer, modify, or redistribute the extension or its source code without our written permission.
Use automated scripts, bots, or tools (other than this extension) to scrape, crawl, or overload our servers or Depop's infrastructure.
Circumvent or disable any security features of the Service.

5. Third-Party Platforms

Popup interacts with Depop's platform on your behalf. We are not affiliated with, endorsed by, or in partnership with Depop Ltd. Your use of Depop is separately governed by Depop's own terms and policies. We are not responsible for any consequences arising from actions taken on your Depop account, including listing removal, account suspension, or other enforcement by Depop.

It is your responsibility to ensure that your use of Popup complies with Depop's Terms of Service at all times.

6. AI-Generated Content

The AI description feature generates listing copy using Google's Gemini API. AI-generated content may contain inaccuracies, errors, or inappropriate suggestions. You are solely responsible for reviewing AI-generated descriptions before publishing them to your Depop shop. We make no warranty regarding the accuracy, suitability, or quality of AI-generated content.

7. Intellectual Property

The Popup extension, its code, design, and branding are the property of the Popup developer. Your listing content (descriptions, photos) remains your own intellectual property. You grant us a limited, non-exclusive license to process your listing content solely to the extent necessary to provide the Service (e.g., passing text to the AI API, re-uploading photos to Depop's storage).

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. We do not guarantee any particular outcome from relisting your items (including increased sales or visibility).

Because the Service depends on Depop's API, changes to Depop's platform, API, or policies may affect or break Service functionality at any time without notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim (or USD $10 if you have paid nothing).

10. Indemnification

You agree to indemnify, defend, and hold harmless the Popup developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of the Service, or your violation of any third-party rights, including Depop's Terms of Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. You may terminate your account at any time via the Account page or by emailing us.

Upon termination, your right to use the Service ends immediately. Sections 7–10 and 13 survive termination.

12. Changes to the Service or Terms

We reserve the right to modify or discontinue the Service at any time. We may update these Terms periodically. If we make material changes, we will update the "Last updated" date at the top of this page and may notify you by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first; if that fails, through binding arbitration or the courts of competent jurisdiction in your local area.
